Compliance monitoring

ARNECC, on behalf of the Registrars in each State and Territory, conducts compliance monitoring and enforcement activities with regard to the requirements of Electronic Lodgment Network Operators (ELNO) and Subscribers to an Electronic Lodgment Network (ELN).

For ELNOs, the requirements with which they are required to comply are set out in the Model Operating Requirements and the respective Operating Requirements in each State and Territory and include the requirement for ELNOs to monitor the compliance of their Subscribers. If found to be not complying with requirements, an ELNO's approval to operate can be suspended or revoked.

For Subscribers, the requirements with which they are required to comply are set out in the Model Participation Rules and the respective Participation Rules in each State and Territory. If found to be not complying with requirements, a Subscriber's access to an Electronic Lodgment Network (ELN) can be restricted, suspended or terminated by direction to the ELNO.

ARNECC prepares annual compliance monitoring and enforcement programs.
